GG / YTMD Temporary issues...

Apologies for the downtime, we were offline due to supposed Trademark Infringement. See Letter Below:
HostGator Legal Department May 17 (6 days ago) to me Hello, We received notice from an Intellectual Property Rights owner, or its authorized agent, that content posted on your website violates their intellectual property rights. Enclosed is a copy of the notification we received. Please remove or disable access to the allegedly infringing material within 48 hours, and provide written notice to us to that effect when completed. Given the serious nature of the claims alleged, we ask that you give this matter your immediate attention. If you fail to expeditiously eliminate or disable access to such allegedly infringing material, we will have no alternative but to suspend or terminate your website(s). Please reply with any questions. This letter is sent without prejudice to IWL Enterprises Inc. and LaToya Howard's rights and claims, all of which are expressly reserved. Please direct any communications regarding this matter to my attention.     Couldn't you just deactivate the Latoya thread and put the rest of the site back up until that issue is resolved?

    If the notice was sent to GG admins 6/7 days ago, why was that specific thread not removed or hidden prior to the 48 hour deadline as instructed? I'm assuming (per the letter here) that this is why the side is down, because the admins failed or refused to comply with Hostgator's order to remove the "offending" thread/section in time. Or am I misunderstanding the situation?

      Actually, the email never came directly to me, or I would have dealt with it right away. It was human error, it happens. The email wasn't noticed quickly and therefore we got our account temporarily suspended until we removed the content we allegedly were infringing upon.

    This seems like more of a freedom of speech issue than it is trademark infringement? How the HELL is talking about someone trademark infringement? that makes absolutely NO sense. She found the site and got her feelings hurt more like. Probably spent all night writing that letter lol.

      apparently...... we will adjust our site accordingly and attempt to avoid further complications.

      That being said, yes, we feel it's an infringement on our freedom of speech!

    Yep, down again...I guess that's one way to get people to stop talking about you, by claiming copyright infringement if they are saying anything about you that you don't like. Would she be trying to stop this if it were a fan site that was only praising her?

    She’s reaching. That’s not how trademark works. We can write/say Walmart, Target, McDonald’s, etc. and all of those are also trademarked. If she wants to bring a defamation case that’s one thing. But trademark does not prevent people from talking about your name, brand, etc. this would never win, and definitely not in the U.S. it’s an infringement on web-users free speech. Also, being a YouTuber could make her a public figure. In that case, she’s screwed in any defamation case she tries to bring. I say when it comes back on everyone voice their opinions in her thread. She can’t threaten people into silence.
